A house building permit - what is it and who does it apply to?

The implementation of construction investment is a large undertaking. Before a dream building is erected on the plot, a lot of formalities must first be completed. One of them is a building permit, without which we will not be able to start the investment. This applies to both "standard" properties, as well as some based on modular construction.

This important document is an administrative decision that we must obtain:

• By building a new facility.
• By expanding the building.
• By building up the floor.
• Rebuilding the house.
• By rebuilding the facility.

Building permit - how to arrange?

A building permit is issued by the department of architecture in an office appropriate for the investment (district office, voivodeship office, district office of the capital city of Warsaw or city offices with district rights).

Usually, applications are submitted to the starosty or city office with regional rights. The provincial office examines more complex applications, for example, those related to buildings of strategic importance:

• Situated on the technical belt.
• In other areas designated for traffic maintenance and maritime transport.
• National and provincial public roads.
• Situated in the railway area.
• Civil airports with associated facilities and devices.
• Situated in closed areas.

Building permit - documents

Applying for a building permit requires the completion of some important documents. Before we go to the appropriate body examining our application, let's first try to:

• The application for a building permit (it can be downloaded, for example, from the website www.biznes.gov.pl).
• Three copies of the plot or area development plan.
• Three copies of the architectural and construction design.
• Statement on the right to use the property for construction purposes.
• The decision on building conditions and land development, if it is required in accordance with the provisions on spatial planning and development.
• Designer's statement regarding the possibility of connecting the designed building object to the existing heating network.

Importantly, to the development design and architectural and construction design, we must attach a copy of the certificate of the Chamber of Professional Self-Government confirming the qualifications of the architect responsible for the project - regardless of whether it is a container office or a modular house. He is also obliged to make a written declaration that the document created by him was drawn up in accordance with the applicable rules and regulations.

The type of investment and its location may require additional permits, arrangements or opinions, including, but not limited to:

• Decision on determining the location of a public purpose investment.
• Permits determining the location of artificial islands, structures and devices in Polish sea areas.
• Permits to agree with the appropriate staroste on the issue of the building line, elevation, route of roads and technical infrastructure.
• Road traffic safety audit results.

However, these are supplementary documents, the necessity to be attached to them is regulated by specific provisions. Therefore, this does not mean that they will be required for an Investor who decides to buy a commercial container or a year-round modular house.

Obtaining a building permit - how long does it take?

After submitting the application for a building permit and attaching all the required documents, the office has 65 days to consider it. It is worth noting here that the process of completing all the documents necessary to start construction may take from 4 to even 6 months. This is a period that should be taken into account when planning the entire project. Modular construction and fast implementation time will allow a bit to "neutralize" the length of the process in relation to the choice of the traditional method of erecting buildings.

The issued building permit is valid for 3 years from the date of its issue. If we do not start construction during this time or we stop it for more than 3 years, we will have to try to obtain such a decision again.

Building permit and other necessary documents - New modular house STEP BY STEP.

An investor who already owns a plot of land and has a vision of its development should first contact a surveyor in order to commission a map for design purposes. Properly delineated dimensions for a container house or a shopping container are the basis for further action. What next? Below, we present the STEP-BY-STEP instructions on what to do to start construction.

1. Surveyor prepares a map for design purposes.
2. The created map must be certified by the local building permit office. This stage takes 5-6 weeks in total.
3. At the same time, we can work with the architect on the concept of the designed building. Even a small modular house can bring long hours of discussion with an expert.
4. We are applying for the issuance of conditions for the supply of utilities (offices require conditions for the supply of gas).
5. After obtaining the above-mentioned documents and the design, we start applying for a building permit. The documents needed to submit the application are listed above. The office has 65 days to process our application.
6. After receiving a positive answer, the obtained permission will become final after 2 weeks.
7. Next download the Construction Log. It is issued by the office where we applied for a building permit.
8. We employ a construction manager.
9. The construction manager reports the commencement of construction works.
